1. Introduction and acceptance
These Terms & Conditions (the “Terms”) govern your use of tryakshaay.com (the “Website”) and the interior design and execution services provided by Tryakshaay Interiors (“Tryakshaay”, “we”, “us”), Panchshil Towers, C-1501, Kharadi, Pune, India.
By using the Website, requesting an estimate or engaging us for a project, you agree to these Terms. If you do not agree, please do not use the Website or our services.
Where you sign a project quotation or agreement with us, that document and these Terms apply together. If they conflict, the signed document prevails.
2. Definitions
Client means the person or organisation engaging us. Services means design, consultation, project management, execution and Vastu consultation services we offer. Quotation means the written, itemised price we issue for a defined scope. Site means the premises where work is carried out.
3. Eligibility
You must be at least 18 years old and legally able to enter into a contract under Indian law. If you act for a company, you confirm you are authorised to bind it.
4. Using the Website and cost estimator
The cost estimator on the Website gives a rough, indicative range only. It is not an offer, quotation or guarantee of price. Actual costs depend on site conditions, scope, material selection, design detailing and market prices.
You agree to provide accurate information and not to misuse the Website, attempt unauthorised access, or copy or scrape its content for commercial use.
5. Getting started: consultation and design
- You contact us and share your requirements, budget and Site details.
- We hold an initial consultation and, where needed, a Site visit and measurement.
- We prepare design concepts, layouts, material selections and 3D previews, and issue a Quotation.
- Detailed design work begins after you approve the design and Quotation in writing and pay the 5% booking payment. Execution at your Site begins only after the 50% payment is received (see Payments).
Design drawings, renders and concepts are our intellectual property until paid for in full. You may use them only for the project they were created for.
6. Quotations and pricing
A Quotation is valid for the period stated on it. Prices exclude GST and other applicable taxes unless stated otherwise.
Any change to the approved scope, materials or specifications after approval is a variation. We will give you a revised cost and timeline, and proceed with the variation only after your written approval.
Items you choose to supply yourself are not covered by our warranty or timelines.
7. Payments
Payments are made in four stages, each a percentage of the total project value in your approved Quotation (including taxes):
- Booking — 5%. Payable when you approve the design and Quotation and book your project.
- Start of execution — 50%. Payable before execution begins at your Site.
- Final installations — 35%. Payable before final installations, such as furniture, fittings and finishing, are carried out.
- Handover — 10%. Payable at completion, against handover of the finished space.
Variations and add-ons approved during the project are billed separately and are due when invoiced, unless the variation approval states otherwise.
Work may be paused if a payment is overdue, and delivery timelines will extend accordingly. Handover will not take place until all amounts due have been received.
We accept the payment methods listed on the Quotation. Please make payments only to the bank accounts or channels named in our official documents, and confirm any change of details with us directly.
Delayed payments may attract interest or charges as stated in your signed agreement.
8. Timelines and delays
We give an estimated project timeline with each Quotation. Execution timelines are counted from the date we receive the 50% payment and you give us access to the Site, not from the booking date. Timelines also depend on timely approvals, payments at each stage, and availability of materials.
Delays caused by the Client, society or landlord restrictions, statutory approvals, force majeure events or third-party suppliers are outside our control, and the timeline will be extended by a reasonable period.
9. Client responsibilities
- Provide safe, timely access to the Site, along with utilities such as water and electricity.
- Obtain any permissions required from housing societies, landlords or authorities, unless agreed otherwise in writing.
- Make timely decisions and approvals.
- Disclose known structural, plumbing or electrical defects in the Site.
10. Cancellations
You may cancel by notifying us in writing. The effect of cancelling depends on the payment stage you have reached:
- After booking, before execution (5% paid): the booking payment is retained against design work done and any materials ordered or made to your specification. If these cost more than the amount paid, you will pay the difference.
- After execution begins (50% payment made): you will pay for work completed, materials procured or made to your specification, and work in progress up to the cancellation date. Any amount you have paid beyond this will be refunded as set out in your signed agreement; any shortfall is payable by you.
We will give you an itemised statement of these charges on request.
Custom-made and made-to-order items cannot normally be cancelled once production has begun.
11. Refunds and returns
Because most of our work is custom-made and site-built, refunds are limited to the circumstances described in your signed agreement and in the Cancellations section. Payments made for a stage are not refundable once the work or materials for that stage have been delivered or procured. Where we are unable to deliver an agreed item, we will offer a replacement or refund its paid value.
12. Warranty and care
We stand behind the quality of our workmanship for the period stated in your Quotation or handover documents. Manufacturer warranties apply to branded products and fittings.
The warranty does not cover damage from misuse, improper maintenance, water seepage or structural issues in the Site, modifications by others, normal wear and tear, or natural events. We will share care instructions at handover.
13. Handover and snagging
At completion we will walk through the Site with you and hand over the finished space against the final 10% payment. Minor defects noted at that time (“snags”) will be listed and rectified within a reasonable period. Use of the Site after handover indicates acceptance, subject to any listed snags and the warranty.
14. Photography and portfolio
Unless you tell us otherwise in writing before work begins, we may photograph completed projects and show them in our portfolio and marketing, without disclosing your personal contact details.
15. Intellectual property
All content on the Website, including text, images, logos and designs, belongs to Tryakshaay or its licensors and may not be reproduced without our written permission.
16. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss caused by events beyond our reasonable control. Our total liability for any claim relating to a project is limited to the amount you paid us for that project.
Nothing in these Terms limits liability that cannot be limited under applicable law.
17. Complaints and grievance redressal
If you have a concern, write to us at tryakshaayinteriors@gmail.com. We will acknowledge your complaint promptly and aim to resolve it within a reasonable period.
18. Governing law and disputes
These Terms are governed by the laws of India. We will first try to resolve any dispute through good-faith discussion. Failing that, the courts at Pune, Maharashtra have exclusive jurisdiction, unless your signed agreement provides for arbitration.
19. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “last updated” date. Continued use of the Website after changes means you accept them.
